    Dear All students

    I receive calls almost everyday from students that their applications as Tier 4( General) student Migrant under Point Based System have been refused. I have been dealing with similar cases every day. There are mainly two folds to refuse students' application:

    a) Students are unaware of current Immigration Rules that they have to maintain maintenance (funds) in their accounts for two months, ie., Inner London £800 x2= £1600 and outer London £600x2= £1200 plus their tuition fees. Maintenance means money for course fees and your living costs.

    b) The colleges/academic institutions are failed in advising students how maintenance (Funds) plus tuition fees can be satisfied to extend leave to remain to be endorsed by the the UK Border Agency. How sponsor can issue standard visa letters to students? Also Students are failed to find out whether colleges are A rated sponsor. You should always check with an education provider that is approved by the UKBA and has been given a licence to bring students to the United Kingdom under tier 4 of the points-based system

    In addition to above, I have seen students still provide source of funds from their sponsors (father, brother, uncle or relatives) which is not intention of current Immigration Rules. Now only official financial sponsor can be used who is sponsored by Her Majesty’s Government, their home government, the British Council or any international organisation, company or university. The student can not use source of funds from sponsor. Therefore, funds must be in student's account.

    How you can succeed to extend your student visa under PBS. You must have a minimum of 30 points under Attributes section and must have a minimum of 10 points under maintenance (Funds). Therefore you need to provide bank statement or letter confirming that you have enough money available to cover your course fees and monthly living costs , at the time of your application. You must show that you have held the money for at least be more than one month before the date of your application.28 days. The end of that 28 day period must not be more than one month before the date of your application.

    You must not be applying for leave to remain for the purpose of studies which would commence more than one month after your current leave to remain expires. You may need to show a lower amount of money for your living costs if you have done a course of study in the United Kingdom in the last four months before you apply or are currently studying and need more time to finish your course; and you can apply showing the lower maintenance costs, whether you are applying from inside the United Kingdom for an extension that course was six months or more in length.

    If your course is nine months or less in Inner London Course then you have to provide evidence that you have paid your fees and £800 to cover living costs for each calendar month of the course up to a maximum of two months. (£1600 in total and evidence of paid tuition fees). If your course is nine months or less in Outer London or anywhere else in the United Kingdom then provide evidence of paid Course fees,and £600 to cover living costs for each calendar month of the course up to a maximum of two months. (£600x2= £1200 )

    There are other provisions that if your course is more than nine months Inner London, you need to provide evidence that you have paid First year of fees, and £1,600 to cover two months of living costs. Similarly, if you are studying Outer London or anywhere else in the United Kingdom then provide evidence of paid of First year of fees,and £1,200 to cover two months of living cost.

    You cannot apply for the lower amount of living costs if you have finished your course more than four months ago; or the course you finished was less than six months.

    If you follow above routes then I do not see any reasons to refuse your application as a Tier 4 (General) Student Migrant under PBS.
    I believe this guidance gives all students a breathing space when you are applying as a Tier 4 (General) student.

    Namaste Dai,

    How about progress report dai? If we get 40 points then will we get visa or they will look about our exams report as well then if satisfied then issue visa?

      thanks again for keeping it simple dai.with regards to the maintaineance fees, i just looked at the ukba website and it says there r transitional arrangements that allow applicants to show that they have the money to meet the maintaineance requirements on the day that they apply rather than a period of 28 days prior to the application until 30 september 2009.correct me if i am wrong.

      and, being a student it is ur duty to pass the exams so having a good progess report certainly helps.

                  i am a student (PG HOSPITALITY MANAGEMENT) FOR A YEAR IN bLACKPOOL AND FYLDE COLLEGE IN BLACKPOOL ITS A YEAR PROGRAM. ITA 6 MONTHS PLACEMENT AND 6 MONTHS ACADEMIC COURSE. NOW I AM LEAVING TO SCOTLAND FOR PLACMENT FOR 6 MONTHS AND GOING TO WORK IN A HOTEL FOR 9 MONTHS INCLUDING 3 MONTHS SUMMER VACATION . I WOULD LIKE TO YOU TO ANSWER IF I AM ELIGIBLE TO APPLY FOR post study work. thanking you

                    Dear Pursu

                    I undrestand that you want to change your status from Tier 4 (General) as a student to Tier 1 (Post Study Work) migrant programme. You have stated that you are a student doing Post Graduate Hospitality Manngement. Most of Post study work queries , I have already anwered in this forum. Your main question in concerned whether or not PG in Hospitality Management makes you eligible to apply for PSW.
                    The PSW category is designed for international graduates who have studied in the United Kingdom. In this category,successful applicants are granted permission to stay as a post-study worker and are free to look for work without having a sponsor for the length of their leave.

                    Anyone can apply under the PSW category if they are in the United Kingdom with permission to stay under the Science and Engineering Graduates Scheme (SEGS), International Graduates Scheme (IGS) or Fresh Talent: Working in Scotland Scheme (FT:WISS). But this is not your case.

                    Viewing your qualification you are not eligible to apply for PSW. The Post Graduate scheme (except below)has been abolished now. The applicant must show that either he is awarded from the United Kingdom recognised Bachelor’s or Postgraduate degree or the United Kingdom Postgraduate Certificate in Education (PGCE) or Professional Graduate Diploma of Education (PGDE); or a Higher National Diploma (HND) from a Scottish institutions.


                    Also bearing in your mind, if anyone wishes to apply for leave to remain within Tier 1 (Post-Study Work), he/she must score enough points together with sending supporting evidence.
                    -75 points for attributes
                    -10 points for English language
                    -10 points for maintenance (funds)

                    For above reasons, you are not eligible to apply for PSW. I believe this claries you matter.

                      Dear Raju dai, thank you a lot for your kind information now i know i was cheated in nepal by an agent. i am interested to stay here for 2/3 years so that i can learn some skills required in hospitality management . recently going to work in scotland for 10 months. what would you suggest me in this case? are there any ways of extending my staying period here? pls kindly reply .

                        Please provide details of agent who has misrepresented you in Nepal in which case others should not be suffered in future. There is an option for you to extend your visa as a Tier 4 (General) provided that you satisfy attributes (Visa letter or Confirmation of Acceptance for Studies) - and maintenance (Funds) and your sponsor must be registered with UKBA, most preferably A rated college.

                        Please follow above guidance to know how to apply for extension to all students. There are some changes in Immigration Rules that students remain in the UK need to satisfy maintenace (Funds) at the date of application. This provision will only appy who apply after 5th October.

                        I believeI have covered your issue.

                          Dear Raju dai,

                          I am not going to ask any question but rather I want to add one appreciation thread. I recently saw the video fo plight of nepali student in UK in nepalisamajuk.

                          Most of the member there offered to help nepali student and gave the talk. I think most of that was very shallow. Without pointing finger to specific college or person I can safely say many of the colleges principal went to nepal and didn't show the proper picture of UK study to the student. They clearly lied to it ( entirely my opinion....whatever they said in speech is immaterial) . Even when you go to the website of colleges you will see the pictures of london bridge, london eye, big buildings, many students, whites, blacks etc. So there whole motive is to decieve students and I feel pity for the students.

                          out of many speakers who gave their speech I believe that you are probably one of very few who has been genuienly helping nepalese and we can actually see it.

                          you have been helping nepalese by providing free service for a long time now through the website. It means a lot to us. We are always fortunate to see your interview in television or in newspaper and always helps us to get aqualinted with latest immigration laws. If for the same information we go to the lawyer probably they will charge 50 pound an hour.

                          we nepalease are very fortunate to have you in UK. It is a great social service you are providing to the nepalese. We appreciate your work alot.

                            Thank you for your kind message. I have run a session for Nepalese students on 8th November 2009 and able to know that many students are suffering in the UK and advised them what steps they need to take.
                            If you are unaware about your rights you can contact to Citizen Advice Bureau or any qualified lawyers. I am always willing to help for your best interest.

                              Hello Mr. Raju,

                              I posted the post twice. My name is not Anju. I do not wish to enclose my name out in the public but here is my problem.

                              I had applied for my student visa to get extended and my college guided throughout everything. They gave me all the information I needed and what I should do to fill the form and what documents to supply. If only I had seen this post earlier when I was applying for my visa, because my visa got rejected due to insuffiecient points in both maintenance and studies.

                              My college told me that I could have my father sponsor me, the first mistake, because the rules had changed. My visa expired on the 30th of August. Then on top of that they included a bogus previous college result. I didn't have the transcripts for that college because it was pending and I had just given my exams. When asked why they included that on my visa letter, they said it didn't say it was the results, it said it was the acceptance letter. But no where did it properly enclose that. This was completely weird to me. You see, the qualification required for them was an A level, O level/+2 and the IELTS. My previous college was not even relevant to them since it had to do with diploma in Art/music. I had submitted my A level and O level results however.

                              So my visa got rejected and I appealed. I hired a lawyer and my appeal date was around the first week of december. Then what happened was the representative of the home office didn't show up so it was just me, my lawyer and the jury. So he said he couldn't decide. My lawyer also told the jury that it wasn't completely my fault in this matter. But they wrote to me back saying that it was my fault for not checking in. I checked the rules, I told the college if I should send more documents, does it still become my fault if they ask me to just do what I am told and that they know it all?

                              My lawyer has filed up a letter appealing again, asking them to re-consider this matter since I am in the middle of my studies. I have wasted so much of money in this matter. What do you think I should do if they don't co-operate?
