    student and ILR holder nepalese

    What's the procedure for a nepalese student and a nepalese ILR to get legally married here? OR, How to change the visa status of student into ILR?

    ILR Holder doesnot need to obtain Certificate of Approval (COA) but student has to but the good thing is they have abolished the fee part of it therefore its free to get COA. Once you get COA, I think you need to produce that to local registrar and give notice them of your intention to get married. They will make you to wait for 15 days (best guess) before they officially accept you as husband and wife. Once you receive certificate of marriage, send it to Home Office for the spouse visa which should be granted for 2 years provided you meet the other criteria prescribed under the rule. After spouse holding spouse visa will be eligible to apply for ILR provided that the marriage is still sustaining.

    Hello Arjun Ji...are you sure that getting COA is free now?..I thought it was 295. Please let me know as i'm planning to apply one as well. Thank you

    The correct fee for COA is 295 who are subject to immigration control. This has not been abolished. The ILR holder does not require to obtain COA. The rest you have clarified.

    Sorry to say the fee being abolished and am correcting now, the fee has been suspended since the 9th Apr 2009 therefore you definately do not need to pay for it at the moment. I dont know how long that is for but currently, there is no fee applicable. It has been suspended in order to comply with the House of Lords judgment in the case of Baiai v the Secretary of State for the Home Department.     However wanna bother you again... after getting COA do we both need to go Nepal to get married and come back with the Marriage Certificate to provide to home office or ??? or is there any other options over here?

    Hello Rajuji & Arjunji.

    I had missed to mention few things on my pervious posts which i am going to add here to make my question bit clear.

    I have got ILE FROM NEPAL THROUGH MY DAD AND IN MY VISA ITS MENTIONED I AM DEPENDENT ON MY DAD . Its been already 2 and half years i have been living in London. Since 2 years I have been doing full time parmanent job.

    Now the question is... does my ILE allow me to marry/sponser my partner who is here in Student visa since 3 years to apply for COA and further Spouse Visa.

    Is there going to arise any objection for my partner to apply Spouse visa after we get married as due to I have got ILE through my dad.

    I would be very grateful to have your replies.

    Dear Viewer

    You hold ILE through your dad.This means there is no restriction on your visa. You are entitled to marry as long as you both are minimum of 21 years old under current Immigration Rules. You need to show your relationship with your girl friend and it is subsisting. Then you need to satisfy that you can adequately maintain and accommodate to her without recourse to public funds. You are on full time employment. I don't see you have problem to marry your girl friend and switch her category into spouse visa.
