    Please help- Student Visa Dilemma

    Hello,
I was wondering if I could get some visa advice please.
I am currently in the country under Fresh Talent : Working in Scotland Scheme. This visa expires in August. I have recently been accepted by an English University to do my Masters.
I would like to know whether I could apply for a student visa after staying under FT:WISS without leaving the country. I was told by a Home Office representative a couple of years ago, that I would have to go back to Nepal to do so. Do I still need to find a sponsor? Is it just the regular student visa form or is there any other form I need to fill?
Also, would it be advisable to apply for an extension to stay under any other scheme, what other options are available?
Your speedy response would be most appreciated.
    Thankyou.

Re: Please help- Student Visa Dilemma

    Dear All
I understand that you are currently under Fresh Talent: Working in Scotland Scheme and your visa is due to expire in August 2009. You wish to switch your category into student. As you are aware that student falls within Tier 4 (General) Student point based system under the Immigration Rules.

You have been granted leave to remain as a Participant in the Fresh Talent: Working in Scotland Scheme. You can switch the category into Tier 4 (General)student. This type of application form can be downloaded from the Home Office website http://www.ukba.homeoffice.gov.uk/si...pplicationform and look at the guidance note before you apply as a student athttp://www.ukba.homeoffice.gov.uk/sitecontent/applicationforms/pbs/Tier4migrantguidance.pdf. This form is in different format which contains of 55 pages.

In relation to your admission to the University, please note that your approved education provider is your immigration sponsor while you are in the United Kingdom and must comply with a number of duties. The education provider must be approved by the UK Border Agency and must hold a licence to bring students to the United Kingdom. You should check that once they are licensed, they are given a rating and added to tier 4 register of sponsors also known as education providers. Please be aware that the status of the licence may affect your application. Then the education provider is able to issue a visa letter that you need to apply, which is the proof you are doing a course with an approved education provider

As your second question is concerned with maintenance (funds), you need to satisfy to cover your course fees and monthly living costs at the time you submit your application. You need to get 10 points for your funds. It depends on where you are studying and how long you are studying for.
You may also show an official financial sponsorship to cover some or all of the money you need.
The UK Border Agency guidance clearly states that there are three different elements of money you must show, which are the cost of your course fees, money already paid and money to be paid.
I believe this clarifies your query.

    Good luck for your career.

    Dear Raju dai,
Thank you very much for your speedy response. Just a couple more queries, when should I apply for a visa ending on August 19th?
Would it be okay to show bank account of a relative living in U.S. as part of my maintenance? Is there a set format of letter or a form they need to fill up to do so?

I really really appreciate your help,

    Thankyou

    Dear All

You can apply within 28 days prior to expiry of your visa. You may ask your relative to transfer the funds in your account with covering letter that he is willing to support for your maintenance during your study. You may ask him undertaking for maintenance as a sponsor for your studies.

I believe this information will help you to process your application.
