    Recently Married, eligible for BN(O) or not..

    Nameste raju dai,

    I have been living in the uk for more than 5 years and now got the British citizenship. The problem is that my wife is still in Nepal and we recently got married. Even though her parents have been living in Hongkong for a long time, she hadn't applied for BNO. Now that we have married and she is planning to come to the UK, her parents are planning to apply for her BNO. Is she eligible for BNO or not. Or if she makes it though will it have any effect later on when she comes here in the UK.

    I tried looking for it all over the place but couldn't find the answer. Therefore I've come for your help. Can you please suggest me what to do or places where I can go and find the answer.

    I understand that you hold a British citizen. If your wife is in Nepal and hold Nepalese passport she does not need to wait for BNO passport. I doubt it very much that she is entitled for both passports. She is coming to the UK as a spouse visa on basis of marriage provided that

    (ii) the parties to the marriage have met; and

    (iii) each of the parties intends to live permanently with the other as his or her spouse and the marriage or civil partnership is subsisting; and

    (iv) there will be adequate accommodation for the parties without recourse to public funds in accommodation which they own or occupy exclusively; and

    (v) the parties will be able to maintain themselves adequately without recourse to public funds; and

    (vi) the applicant holds a valid United Kingdom entry clearance for entry in this capacity.

    So you should send her all documentations to sponsor her confirming that marriage is genuine and is still subsisting provided that above requirements are satisfied. She needs to fill in VAF4a application form.
