What happens if College looses sponsorship?

Hi Raju Dai and others on Student Visa.
Please shed some light on my query. What will happen to the student of the college whose sposorship licence has been suspended by UKBA? Will there be any problem during visa extension? Can the student attend college as normal without changing the college or should they consider changing it to avoid problem during visa extension?

    Many Thanks

Yesto JPT suggestion dine ho. What do you want poor student to be deported or their image to be marred by criminal offence.

UK is not nepal. There must be some legal ways to get the money back if college could not deliver what they promise in the first place.

Don't give bakamfuse idea of dhamki, threatening and beating.

Re: What happens if College looses sponsorship?

If college lose sponsorship, they are given 28 days to rectify the cause of losing the sponsorhip and once it has been rectified, college should inform ukba. ukba can take some months to bring the college back to the sponsor list, they dont confirm how long it will take; could be 1 month or 2 or 6, maybe more.

Now while they are out of the lists, they cannot enrol international students i.e students will not be granted visa to study in this college. Also students whose visa is due to be expire will not be extended. Those students whose visa is due to be expired and their college is not in the list (anymore), they should change the college (following the same level of course) and inform ukba by emailing on migrantreporting@ukba.gsi.gov.uk.

Even college is not in the sponsorship list, they can continue to provide the education to the students.

    im just sharing the knowledge.
raju dai, correct me if im wrong.
when you are behind the current technology, remember google!!!!!!!!

Re: What happens if College looses sponsorship?

    Dear viewer

I strongly advise you to take immediate legal action for those colleges who have been cancelled by the UKBA. I have been receiving calls every day in this particular issue. I have also advised students to bring their genuine complain so that I could protect their interests and secure their immigration status. I do undertstand your problem. If your college is removed from the list after you submitted your application for leave to enter or remain as a Tier 4 (General) student , you can find yourself in a real grey area. Finding out that your college has been removed from the UKBA Sponsors Register after you’ve submitted your visa application is quite a common occurrence. Even a perfectly legitimate and respectable colleges can be removed / suspended from the tier 4 register at any time if they do not comply with sponsorship duties. For example, recently Holboln College is not in sponsor lists. What are the possibilities? If colleges have been removed from the register and they have reported the matter to the UKBA, they may gain return to the UKBA sponsor register if they have complied with requirements.

Unfortunately, it’s not a simple case of delaying the start date of your course and waiting for the college to address the issues raised. I’ve received calls from several students who’ve had their visa application refused as their sponsoring college doesn’t appear on the register, and while they are studying their colleges are not in sponsor lists. This is very serious and utterly ridiculous to victimise the students. Most of colleges have set out the terms and conditions that a refund is usually only possible upon producing student visa refusal letter. So if you simply chose to cancel your enrollment and apply elsewhere, you’d need the extra cash available to pay for a new course. Again maintenance (funds) must be intact to satisy the Immigration Rules.
According to the guidelines set out under tier 4 of the UK Border Agency’s Points Based System, British Embassy/High Commission will put your application on hold if college gets removed from the tier 4 register of sponsors while your application is pending. This is common problem when students have had their tier 4 general student visa application refused because their colleges are no longer appeared on the sponsor register. You could get different answers from colleges that their license has been held but not cancelled, the UKBA is in the process to put their name back into sponsor lists. Students must be aware that old tricks will not be in your favour.

Normally, it takes 3 – 6 weeks to satisfy the UK Border Agency’s concerns and can be re-included on the register of sponsors. First you should keep in touch with your colleges to get further details on why they have been removed from the register, but it is unlikely they will tell you truth. You must ensure that you stay in contact with your colleges, and also obtain get regular updates from them. Should you need to renew your visa before they appear back on the list, you have to find out different colleges with A rated on the register of sponsors before you run into serious problems. They may not give you valid reasons for being suspended.

Below are news who have been jailed for running bogus colleges.

    http://www.adviceforyou.org.uk/blog/...d-gang-jailed/

I understand these issues are causing a great anxieties and distubances for the students. You should always check with the UKBA's website for registered Colleges list. If your colleges are on that list, then you should not worry. If you can not find your college name on that list, then either your college is supended or cancelled. I do understand that number of overseas students are running into difficulty renewing their student visas where the educational provider is not listed on the Tier 4 register of sponsoring colleges. Since Tier 4 of the Points based System was implemented on 31 March 2009, colleges must be licensed by the UK Border Agency (UKBA) to take international students on student visas. Mostly colleges are established to make money within short period of time. Several students are still studying at such colleges that thay have not yet been licensed by the UKBA. Several non-registered colleges also assured that their applications have been sent to the Home Office which leaves the students in a grey area and in very dangerous position that application would take few months to be accredited and registered and if unsucessful it would be rejected. If colleges are not listed, they have to go through the accreditation process with one of the accreditation bodies such the British Council, BAC or ASIC which may take several months to comple the process.Once a college is accredited it can apply for a Tier 4 licence, which will take around six weeks and involve an inspection visit by a UK Border Agency officer. The whole accreditation and licensing process could take up to nine months
Therefore students are being kept in the dark by the colleges, which has applied for the sponsor licence, whilst the clock is ticking on their visas. The main problem seems to be that if their visa expires they will have to leave the UK and could be branded as an ‘overstayer’.
What you should bear in your mind, if colleges appearing on the register will be given a Tier 4 ‘A’ or Tier 4 ‘B’ rating based on a scoring system, but the main point is that they must be in registered lists.
If I can be of any help, I’ll do my best to help you.
    Many Thanks
